What to Do When a Tenant Trashes Your Rental Property

Do you have a rental property in Montgomery, Texas, that’s been trashed by bad tenants? If you’re not comfortable preparing this notice yourself, hire an attorney for the entire process. The notice must meet the state’s requirements, or it will not be considered valid, and the eviction process will be delayed. Often, a notice will be enough to get the tenant off your property.  


After they Leave 

Once the tenant is out, you’ll need to perform a move-out inspection. Document everything with photos to demonstrate damages and debris left behind. Follow Texas law for retaining the security deposit because a tenant can sue you if you fail to fully comply with notices and timelines. 


In this scenario, the damages will have exceeded the security deposit amount. You’ll need to consider small claims court to get compensated for the damages. Unfortunately, if the tenant does not have any money or assets, a court judgment will not help you fund the needed repairs. 


Fix it Up or Sell? 

If you can’t get the money needed from the tenant for repairs, you’ll have to cover the costs yourself or sell the property. Each day the rental remains vacant is costing you money. Even if the property has no mortgage, there are still property taxes and insurance to account for, along with utilities that remain on during repairs. 


If the repairs are significant, or you’re just tired of being a landlord for this particular property, you have the option of selling it fast. You can list with an agent and wait 30-90 days or more to close. Try to sell it yourself, and possibly take longer. This is after you’ve completed all of the repairs, of course. The other option is to walk away within 7-10 days with cash. No repairs. No clean-up. Sell it as is.
